What is Proposition 65?

Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, was enacted as a ballot initiative in November 1986. The proposition protects the state's drinking water sources from being contaminated with chemicals known to cause cancer, birth defects or other reproductive harm, and requires businesses to inform Californians about exposures to such chemicals.

What does this mean for Newmark Corporation?

You will find a warning on various web pages and literature related to the sale of various manufacturers products by Newmark Corporation in the State of California. Newmark Corporation is a distributor of Drain Products. Our Manufacturers have advised us that Prop65 warnings may be required. The California Safe Drinking and Toxic Enforcement Act of 1986 requires a warning for products that may cause exposure to certain levels of chemicals known to cause cancer or reproductive harm. The ca.gov link included in the warning provides complete details regarding the California law.

Why does Newmark Corporation have to mark its products with the Prop 65 label?

In practice, it is very difficult to evaluate exposure levels and whether or not a threshold exposure level has been exceeded. As a distributor, Newmark Corporation, like most manufacturers in many industries, is required to place a warning to customers for all products. The warning does not mean that there is a known risk of cancer or reproductive harm from handling products distributed by Newmark. Most of our Manufacturers products are made from common materials found in many products that you encounter every day. Most people will never come in contact with our products even if they are installed in a facility that you frequent regularly.
